TERMS & CONDITIONS – OLARI ATELIER (Etsy, international sales – EU)

(applicable to orders placed via the Etsy platform)


1. General Information

1.1 The seller is OLARI Atelier (hereinafter: "Seller").

1.2 Sales are conducted via the Etsy platform and are primarily directed to customers within the European Union.

1.3 The products are unique, original works of art and functional art, created by hand on an individual order basis (furniture and objects made of wood and resin, resin paintings on canvas, etc.).


2. Nature of Products

2.1 Each product is made to order according to the individual specifications of the customer, based on photos of previous works presented in the listing as a reference.

2.2 Products are consistent with the style and quality of the presented works; however, each piece is unique – this results from the nature of working with natural materials such as wood and materials such as epoxy resin.

2.3 The Seller does not keep stock – materials are purchased individually for each specific order.

2.4 The designs are original and remain the intellectual property of the Seller.

2.5 Upon request, before production begins, the Seller sends photos of the proposed material (e.g. wood) for customer approval.

2.6 During the production process, contact and consultation are possible – the Seller may send photos of key stages for approval (e.g. composition, layout, decorative elements):

– this applies in particular to projects requiring artistic input,

– in the case of simple projects (e.g. uniform or transparent resin), stage approvals may not be necessary.

2.7 The customer may actively participate in the creation process or grant full creative freedom to the Seller.

2.8 If the customer chooses not to participate in the process, they accept the final result in accordance with the brand's style and previous works.

2.9 Products are made from natural materials (wood, resin), therefore:

– variations in color, structure and grain may occur,

– minor irregularities may appear, including microbubbles in the resin or other natural effects of the production process.

2.10 These characteristics are natural, unavoidable and do not constitute a defect.


3. Conclusion of Contract

3.1 The contract is concluded upon full payment of the order.

3.2 Placing an order constitutes acceptance of these Terms & Conditions.


4. Production Time

4.1 The standard production time is approximately 12 weeks.

4.2 Due to the handmade nature and work with natural materials, the production time may vary.

4.3 The Etsy platform technically limits the maximum declared processing time to 12 weeks – in practice, in the case of more complex projects or situations resulting from the nature of handmade work and natural materials, the actual production time may be shorter or longer and cannot always be precisely predicted at the time of placing the order.

4.4 The Seller makes every effort to meet the declared production time.

4.5 In rare, exceptional situations, production may be extended by several weeks. This results from the nature of handmade work and working with natural materials, which may require additional technological processes such as additional impregnation, stabilization, curing or polishing, as well as other situations arising during the process that cannot be predicted or avoided at the time of order. These factors are beyond the Seller's control and result solely from the commitment to the highest quality. This does not constitute grounds for withdrawal from the contract or cancellation of the order.

4.6 Each product is handmade personally with the utmost attention to detail.

4.7 By placing an order, the customer accepts the above conditions.


5. Right of Withdrawal (EU)

5.1 In accordance with Article 16(c) of Directive 2011/83/EU,

the right of withdrawal (return) does not apply to:

– custom-made products,

– products personalized according to customer specifications.

5.2 All OLARI Atelier products meet the above criteria – returns are not possible.


6. Complaints and Liability

6.1 Complaints may only concern:

– transport damage,

– significant non-conformity with the agreement.

6.2 A condition for considering a complaint is returning the product to the Seller for inspection.

6.3 The Seller has the right to:

– fully assess the product on site,

– first carry out a repair,

– if necessary, create a new product,

– and only if the above is not possible – consider a full or partial refund, appropriate to the identified non-conformity.

6.4 Based on photos alone, the Seller is not obliged to accept the complaint.

6.5 In the case of creating a new product, the standard production time applies, as with a new order.

6.6 Products showing signs of use, wear resulting from normal use or damage caused by the customer do not constitute grounds for a complaint.

Complaints submitted after a longer period from purchase are assessed individually, taking into account the nature of the product, the method of use and the duration of use.


7. Transport Costs in Case of Complaint

7.1 The cost of returning the product to the Seller for inspection is borne by the customer.

7.2 If the complaint is deemed valid, the Seller reimburses the return shipping cost in an amount corresponding to standard market rates for that type of shipment.

7.3 The Seller is not obliged to reimburse transport costs exceeding reasonable market rates.


8. Transport and Returns for Inspection

8.1 Products are carefully secured by the Seller (including polystyrene, foam, protective foil and multi-layer packaging).

8.2 In the case of returning a product for inspection:

– full responsibility for proper packaging lies with the customer,

– the product must be secured professionally as a fragile item or piece of furniture.

8.3 The Seller is not responsible for damage occurring during return transport.

8.4 In the event of transport damage during return, the customer pursues claims directly with the carrier.


9. Payments

9.1 Payments are processed via Etsy Payments.

9.2 Production begins after full payment.


10. Customer Service

10.1 The highest quality and customer satisfaction are the top priority.

10.2 Each product is handmade with full commitment and attention to detail.

10.3 The standard of work is reflected in customer reviews.


11. Final Provisions

11.1 These Terms are governed by European Union law.

11.2 In matters not regulated herein, EU consumer law applies.

11.3 The Seller reserves the right to update these Terms & Conditions.
